You are currently connected to the website, in particular accessible at www.grandecharte.com (hereinafter the "Site") owned by Champagne de la Grande Charte (hereinafter "Grande Charte").

The Site allows the User to access specific and confidential information on prestigious effervescent wines marketed by Grande Charte.

The purpose of these terms and conditions of use is to define how the Site is used (hereinafter the "Terms and Conditions of Use") by users (hereinafter "the User").

Any use of the Site by Users is subject to acceptance and compliance with these Terms and Conditions of Use. The User must make sure to carefully read these Terms and Conditions of Use before browsing the Site.



  1. PROTECTION OF MINORS - CONSUMPTION OF ALCOHOL


The abuse of alcohol is dangerous for your health. Please drink responsibly. The consumption of alcoholic beverages during pregnancy, even in small quantities, can have serious consequences for the health of the child.

In accordance with the provisions of Article L.3342-1 of the French Public Health Code, which stipulates that the sale of alcohol to minors is prohibited, and in accordance with the provisions of Article L.3323-2 of the French Public Health Code, the User undertakes to access the Site only if he/she is of legal age on the date on which the User accesses the Site. Any misrepresentation will incur the liability of its author. The User also undertakes to implement the necessary means to prevent minors likely to use his/her computer equipment from accessing the Site and information relating to the products offered by Grande Charte through the Site.

  1. SCOPE OF THE TERMS AND CONDITIONS OF USE 


The fact that a User uses the Site implies full adherence to and acceptance of these Terms and Conditions of Use, which is expressly acknowledged by the User.

The fact that Grande Charte does not avail itself at any given time of any of the clauses of the Terms and Conditions of Use and/or a breach by the User of any of its contractual obligations cannot be interpreted as a waiver by Grande Charte of the right to subsequently invoke any of the said clauses or contractual obligations.



  1. ACCESS TO THE PRIVATE BOUTIQUE 


In order to be able to access the Site, the User must be in possession of a code (hereinafter the "Code"), which he may obtain from Grande Charte or any person to whom Grande Charte has communicated it for the User.

The Code is personal and non-transferable. It must not be distributed by the User. Failing this, the User shall be held liable.



  1. TECHNICAL RESOURCES


Before using the Site, the User must ensure that he/she has the technical and computer resources to benefit from the services and content available on the Site and that he/she has a browser that allows secure access to the Site.

The User must also ensure that the computer configuration of his/her hardware/equipment is in good working order and does not contain viruses.

Since Grande Charte has no power or responsibility over the Internet connection chain, it cannot guarantee access to the Site.

The User declares that he/she is fully aware of the characteristics and constraints of the Internet, and in particular that the transmissions of data and information on the Internet only benefit from relative technical reliability, these circulating over heterogeneous networks with various technical characteristics and capacities, which disrupt access or make them impossible at certain periods.



  1. USER'S COMMITMENTS 


The User undertakes to only access and use the Site for his/her personal and private use, in accordance with these Terms and Conditions of Use.

The User undertakes to refrain from:

·      using the Site in any unlawful manner, for any unlawful purpose or in any manner inconsistent with these Terms and Conditions of Use;

·      selling, copying, reproducing, renting, lending, distributing, transferring or sub-licensing all or part of the content on the Site, in particular all information and representations relating to wines marketed by Champagne de la Grande Charte;

·      allowing any third party to use or access the Site for any purpose or to decompile, disassemble, modify, display in human-readable form, attempt to discover any source code or use any software enabling or comprising any part of the Site;

·      attempting to gain unauthorized access to the computer system of the Site or engaging in any activity that disrupts, diminishes the quality or interferes with the performance or deteriorating the functionality of the Site;

·      using the Site for misuse by voluntarily introducing viruses or other malicious programs and attempting to gain unauthorized access to the Site;

·      communicating the Code to any third party or circulating it on social networks and, more generally, any public dissemination on any medium whatsoever.

If, for any reason, Grande Charte considers that the User does not comply with these Terms and Conditions of Use, Grande Charte may at any time, and at its sole discretion, remove access to the Site and take all measures including any legal action against the User.



  1. LIABILITY OF CHAMPAGNE DE LA GRANDE CHARTE 


Grande Charte undertakes to take all necessary care and diligence to provide a quality service in accordance with the practices of the profession.

Grande Charte makes every effort to ensure the accuracy and updating of the information and content published on the Site to the best of its ability, which it reserves the right to correct at any time and without prior notice.

The information provided is presented for information purposes only without contractual value.

 

Grande Charte does not guarantee the accuracy, precision or completeness of the information made available on the Site. In particular, the User is informed that:

·      The indications relating to the dosages and/or the grape varieties of the Champagne wines are provided for information purposes only and do not engage the liability of Champagne de la Grande Charte. Concerning the grape varieties and dosages, it is specified that the information transmitted is given to the nearest unit, tenth or hundredth depending on the case.

·      Only the information on the bottles marketed by Grande Charte is binding on the latter.

·      The gastronomic and/or professional guide notes, opinions and comments published are the subjective assessment of each of the authors and cannot incur the liability of the Grande Charte in this respect.

·      Photographs and illustrations are shown for illustrative purposes and have no contractual value.

 

Consequently, Grande Charte disclaims all liability for any inaccuracy or omission relating to the information or content available on the Site and for any damage resulting from a fraudulent intrusion by a third party that has led to a modification or alteration of the information/content contained on the Site or which has caused harm to any User of this Site, and more generally for any damage, regardless of the causes, origins, nature or consequences, caused by anyone accessing the Site or the impossibility of accessing it.

In general, Grande Charte declines all liability in the event of use of the Site that does not comply with the Terms and Conditions of Use.



  1. MODIFICATION OF THE SITE

Service interruptions shall not entitle the User to any compensation.

The User expressly acknowledges that the Site and its content, images, photographs, graphics, drawings, illustrations, layouts, logos, texts and other content are the exclusive property of Grande Charte and are protected by business secrecy, the French Intellectual Property Code as well as by the applicable international treaties and agreements relating to the protection of intellectual property rights.

Grande Charte is the sole owner of all rights, titles and interests in the Site and its content, including all intellectual property rights including, in particular, all rights relating to copyright, design rights and models, trademark rights, sui generis rights of the database producer, as well as the rights relating to signs, trade names, company names, domain names, technology, know-how, processes, formulas, source codes and executable codes, data and similar rights, including information relating to any application, registration or renewal thereof that may be protected by the intellectual property laws, regulations or rules of any country.

Any reproduction, representation, adaptation, exploitation, distribution, broadcasting, commercial use, translation, arrangement, transformation or any creation of derivative or composite works of all or part of the contents or any other element or information appearing on the Site on any medium whatsoever and by any process whatsoever, present or future, is expressly prohibited.

In accordance with the provisions of the French Intellectual Property Code on copyright and the sui generis right of databases, the extraction and/or reuse of all or a qualitatively or quantitatively substantial part of the elements and content of the Site, as well as the repeated and systematic extraction or reuse of qualitatively or quantitatively non-substantial parts of the elements and content of the Site are strictly prohibited.
